“The purpose of this letter is to advise that, due to circumstances beyond the reasonable control of The Dow Chemical Company and/or its Affiliates (“Dow”), Dow is unable to supply the quantities of products listed
– 2-Ethylhexyl Acrylate (2EHA), Butyl Acrylate (BA), Glacial Acrylic Acid (GAA), Methyl Acrylate (MA), Ethyl Acrylate (EA)
– Methyl Methacrylate (MMA), Glacial Methacrylic Acid (GMAA), Butyl Methacrylate (BMA), Glycidyl Methacrylate (GMA)
– ROCRYL™ 400 Hydroxy Ethyl Methacrylate (HEMA), ROCRYL™ 410 Hydroxy Propyl Methacrylate (HPMA), ROCRYL™ 420 Hydroxy Ethyl Acrylate (HEA), ROCRYL™ 430 Hydroxy Propyl Acrylate (HPA)
– Vinyl Acetate Monomer (VAM)
This situation is due to extreme weather conditions that resulted in temperatures below freezing at Dow’s Deer Park, St. Charles, Texas City, Freeport, Bayport and Louisville operations (the “Sites”) , which have
resulted in either involuntary unplanned shutdowns, the inability to load product, or the extension of ongoing outages. Pursuant to the terms of your applicable Sales Contract, Dow is excused from performance during the term of this Force Majeure event. Dow is using all commercially reasonable means to address this situation and hopes to be in a position to resume product supply as soon as possible. This resumption of supply is entirely contingent on a successful start-up, ability to load products, and the resumption of utility services at the Sites.
Dow will allocate available product in a manner that is fair and reasonable. Your allocation volume will be communicated to you by your account manager as soon as possible.
Dow regrets this situation and thanks you for your continued patience during this difficult period. We intend to keep you informed as new information becomes available.”
